Gybe Consulting is a recruitment agency based in Brisbane, Queensland. We specialise in connecting marketing, digital, and sales professionals with employers across Australia.

Some of the third-party service providers we disclose personal information to may be based in or have servers located outside of Australia. We will only disclose to overseas third parties if:

  • You have given us your consent to disclose personal information to that third party;
  • We reasonably believe that the overseas recipient is subject to a law or binding scheme that is, overall, substantially similar to the APPs, and that the law or binding scheme can be enforced; or

Direct Marketing & Online Behavioural Advertising

We may send you direct marketing communications and information about our services or opportunities that we consider may be of interest to you, where you have requested or consented to receive such communications. These communications may be sent in various forms, including email and SMS, in accordance with applicable laws such as the Australian Spam Act 2003 (Cth).

You may opt out of receiving marketing communications from us at any time by following the unsubscribe instructions set out in the relevant communication.

We may also use or disclose your personal information to third parties for the purposes of advertising, including online behavioural advertising, website personalisation, and to provide targeted or retargeted advertising content to you (including through third-party websites).

We are subject to the Notifiable Data Breaches (NDB) scheme under the Privacy Act 1988 (Cth). In the event of a data breach that is likely to result in serious harm to any individuals whose personal information is involved, we will:

  • Conduct a prompt assessment of the breach
  • Notify affected individuals as soon as practicable
  • Notify the Office of the Australian Information Commissioner (OAIC)

Notification will include a description of the breach, the kinds of information involved, and recommendations for steps individuals should take in response. If you believe your personal information has been compromised, please contact us immediately at the details in Section 14.

12. Automated Decision-Making

Note: The following disclosure will become a mandatory requirement under the Privacy and Other Legislation Amendment Act 2024 from 10 December 2026.

Where we use substantially automated processes to make, or assist in making, decisions that significantly affect individuals — such as automated screening or matching of candidates to roles — we will disclose this in our privacy notices and ensure affected individuals are informed of the nature and effect of such automated processes.

At the date of this policy, Gybe Consulting does not use fully automated decision-making in its recruitment processes. All significant decisions involve human review.
